01 Acceptance of Terms
By accessing or using the Site โ including browsing a business page, submitting a claim or enquiry, requesting a design, messaging us on WhatsApp, or purchasing a paid plan โ you agree to be bound by these Terms and by our practices described in Section 14 (Privacy & Data Protection). If you do not agree, you must stop using the Site.
If you are using the Site on behalf of a business, sole proprietorship, partnership, or company, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.
Where you are also completing a business-page claim or Helpr.pk provider onboarding, the Claim & Provider Onboarding Terms apply in addition to, and do not replace, these Terms. If the two documents conflict on a matter specific to the claim/onboarding process, the Claim & Provider Onboarding Terms govern that specific matter; these Terms govern everything else.
02 Definitions

03 Eligibility & Authority
You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering into a binding contract to use the Service. By submitting a business page claim, you additionally confirm that:
- you are the owner of the business, or are authorised by the owner to act on its behalf;
- the business is lawfully operating in Pakistan; and
- you have obtained any consent required from individuals whose information (including staff or personal contact numbers) you submit to us.
04 Description of Services
DigiCard provides Pakistani small and medium businesses with a mobile-optimised business page, which may include a WhatsApp enquiry button, business location and map link, listed services, a Google reviews display, and โ on eligible plans โ additional features such as custom design, a business directory listing, or a free/paid business email address. The exact features, pricing, and inclusions of any Plan are those described on the Site or confirmed with you at the time of order, and may change from time to time as described in Section 18.
The Service is a marketing and presentation tool. It is not a guarantee of business outcomes โ see Section 15.
05 Submissions & Accuracy of Information
When you submit information to us โ whether through a web form, WhatsApp, or any other channel โ you are responsible for ensuring it is accurate, current, and not misleading, and for promptly notifying us of any changes (e.g. to phone number, address, services, or pricing). We are not liable for losses arising from information that is inaccurate, outdated, or incomplete because you did not update it.
Where identity documents (e.g. CNIC images) are requested, this is solely to verify the business and/or its owner for onboarding purposes as described in the Claim & Provider Onboarding Terms and Section 14 below.
06 Verification, Publication & Editorial Discretion
Submitting a business for a DigiCard page does not guarantee that it will be verified, published, kept online, or generate any customer enquiries. We may, at our sole discretion and without liability to you:
- decline, delay, or request additional evidence before publishing a page;
- edit, format, correct, condense, or reject submitted Content for accuracy, quality, legality, or house style;
- remove, suspend, or unpublish any Business Page at any time, including where we reasonably suspect fraud, misrepresentation, illegal activity, or a breach of these Terms; and
- restrict, mask, or withhold contact details until verification is complete.
We aim to act reasonably and in good faith, but publication decisions are commercial and editorial decisions made by DigiCard and are final.
07 Relationship with Helpr.pk
DigiCard.pk is a trading name of Helpr.pk. Where a business page claim also initiates assessment for onboarding as a Helpr.pk service provider, that process is governed by the Claim & Provider Onboarding Terms. Having a DigiCard Business Page does not, by itself, guarantee approval as a Helpr.pk provider or the allocation of any job, lead, or customer through Helpr.pk. Eligibility for Helpr.pk work depends on separate assessment criteria (service fit, location, identity checks, and operational suitability) at Helpr.pk's discretion.
08 Fees, Payment, Refunds & Cancellation
8.1 Fees
Basic Business Pages are offered free of charge. Paid Plans, upgrades, custom design work, business email, and other add-ons are charged at the price shown on the Site or confirmed with you in writing (including over WhatsApp) before you place an order. All prices are in Pakistani Rupees (PKR) and are inclusive of applicable taxes unless stated otherwise.
8.2 Payment
Payment must be made through the method(s) we specify at the time of order. You are responsible for any fees charged by your bank, card issuer, or payment/mobile-wallet provider. We are not responsible for delays or failures caused by third-party payment processors.
8.3 Refunds & Cancellation
Because our Plans involve bespoke work (design, content entry, verification, and publication) that begins promptly after payment, fees are non-refundable once work on your order has commenced or your page has been published, except:
- where we are unable to deliver the Plan you paid for and fail to provide a reasonable substitute;
- where required by applicable Pakistani consumer-protection law; or
- where we, at our discretion, agree to a refund, credit, or replacement in a specific case.
If you wish to cancel an order before work has commenced, contact us immediately via WhatsApp (Section 24) and we will assess your request in good faith. Recurring or subscription-style Plans, where offered, may be cancelled by notifying us before the next renewal; cancellation stops future charges but does not itself entitle you to a refund of amounts already paid, except as set out above.
Any specific refund, warranty, or cancellation terms confirmed to you in writing for a particular order take precedence over this Section 8 for that order.
09 Intellectual Property
The Site, including its design, layout, templates, design-gallery styles, source code, graphics, logos, and the "DigiCard" name and marks, is owned by or licensed to DigiCard/Helpr.pk and is protected by applicable intellectual property laws. Except for the limited right to view and use the Site for its intended purpose, nothing in these Terms grants you any right, title, or interest in our intellectual property.
You may not copy, scrape, reproduce, republish, reverse-engineer, or create derivative works from the Site's design, templates, or code without our prior written consent.
10 Your Content & License to Us
You retain ownership of the Content you submit about your business (text, logo, images, service descriptions, etc.). By submitting Content, you grant DigiCard a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt (for formatting and display), publish, and distribute that Content on the Site and in related marketing of the Service (e.g. the design gallery, social previews), for as long as your Business Page remains active plus a reasonable period thereafter for records and legal compliance.
You warrant that the Content you submit: (a) is accurate and either owned by you or used with the necessary permissions; (b) does not infringe any third party's intellectual property, privacy, or other rights; and (c) is not unlawful, defamatory, obscene, or otherwise objectionable.
11 Acceptable Use
You must not use the Site to:
- submit false, fraudulent, or misleading business information, including impersonating a business you are not authorised to represent;
- upload or transmit content that is unlawful, infringing, defamatory, obscene, or that violates any person's rights;
- attempt to gain unauthorised access to the Site, its data, or other users' information;
- scrape, harvest, or bulk-extract Content, phone numbers, or other data from the Site;
- interfere with or disrupt the Site's operation, security, or availability; or
- use the Site for any purpose that violates the Prevention of Electronic Crimes Act, 2016, or any other applicable Pakistani law.
We may investigate suspected breaches and take any action described in Section 19, including suspension or removal, and may report unlawful activity to the relevant authorities.
12 Third-Party Services & Links
The Site integrates or links to third-party services such as WhatsApp, Google Maps, and Google Reviews, and may use third-party payment or hosting providers. These services are governed by their own terms and privacy policies, which we encourage you to review. We do not control and are not responsible for the content, functionality, availability, or practices of third-party services, and your use of them is at your own risk.
13 Reviews & Third-Party Data
Where Business Pages display Google reviews or ratings, this data is retrieved from Google and reflects Google's own content and policies, not ours. We do not independently verify the accuracy of third-party reviews, do not control their content, and are not responsible for their accuracy, availability, or removal. If you have concerns about a specific review, you should raise it with Google directly; we may assist where reasonably possible but cannot guarantee any outcome.
14 Privacy & Data Protection
We collect the information you submit (business details, contact numbers, and โ for verification/onboarding โ identity documents such as CNIC images) to operate the Service: to create and publish your Business Page, verify your business, communicate with you, process payments, and assess Helpr.pk provider eligibility where applicable.
14.1 Identity documents
Identity documents are used solely for verification and onboarding review. They are not displayed publicly on your Business Page or elsewhere on the Site, and access to them is restricted to personnel who need it for verification purposes.
14.2 Applicable law
Pakistan does not yet have a dedicated, fully enacted data-protection statute; the Prevention of Electronic Crimes Act, 2016 (as amended) is the primary law addressing electronic data misuse, alongside general principles of confidentiality and contract. We handle personal and identity data in line with the consent, purpose-limitation, and security practices reflected in Pakistan's proposed Personal Data Protection legislation as a matter of good practice, even where not yet strictly mandated by statute, and we will update our practices as and when that legislation is enacted.
14.3 Your rights
You may request correction of inaccurate information, withdrawal of a pending claim, or removal of a published Business Page at any time by contacting us via WhatsApp (Section 24). We will action reasonable requests promptly, subject to any records we are legally required to retain.
14.4 Retention & sharing
We retain business and identity information for as long as needed to operate the Service, comply with legal obligations, resolve disputes, and enforce these Terms. We do not sell your personal data. We may share information with service providers who help us operate the Site (e.g. hosting, messaging, payment processing) under confidentiality obligations, with Helpr.pk for provider onboarding purposes where applicable, or where required by law or a valid legal process.
15 Disclaimers of Warranties
The Site and Service are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the fullest extent permitted by applicable law.
Without limiting the above, we do not warrant or guarantee that:
- the Service will result in any specific number of enquiries, leads, customers, bookings, sales, or revenue for your business;
- the Site will be uninterrupted, error-free, secure, or available at all times;
- any Business Page will achieve a particular search ranking, visibility, or placement; or
- third-party data (such as Google reviews) displayed on the Site is accurate or current.
Nothing in this Section excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable Pakistani law.
16 Limitation of Liability
To the fullest extent permitted by applicable law:
- DigiCard, Helpr.pk, and their owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data, arising out of or relating to your use of, or inability to use, the Service, even if advised of the possibility of such damages;
- our total aggregate liability to you for any and all claims arising out of or relating to the Service, however arising (whether in contract, tort, or otherwise), will not exceed the total fees you actually paid to us for the specific Plan or Order giving rise to the claim in the twelve (12) months preceding the event giving rise to the claim, or PKR 5,000, whichever is greater; and
- where you have used only the free Business Page tier and paid us nothing, our aggregate liability to you will not exceed PKR 5,000.
This limitation does not apply to liability that cannot be excluded or limited under Pakistani law, including liability for fraud, wilful misconduct, or gross negligence.
17 Indemnification
You agree to indemnify, defend, and hold harmless DigiCard, Helpr.pk, and their owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your Content or the information you submit; (b) your breach of these Terms; (c) your violation of any law or the rights of a third party; or (d) your business's dealings with any customer, including any customer referred through Helpr.pk.
18 Availability & Changes to the Service
We may modify, suspend, or discontinue any part of the Service, including specific features, Plans, or pricing, at any time, with or without notice. We will make reasonable efforts to inform active paying customers of material changes affecting their Plan in advance, but are not liable for any modification, suspension, or discontinuation of the Service.
19 Suspension & Termination
We may suspend or terminate your access to the Service, or remove a Business Page, at any time if we reasonably believe you have breached these Terms, provided false information, engaged in fraudulent or unlawful conduct, failed to pay applicable fees, or if required to do so by law. Where reasonably practicable, we will attempt to notify you via WhatsApp or your registered contact number beforehand or promptly afterward.
You may request removal of your Business Page and/or cancellation of a Plan at any time by contacting us (Section 24); this does not entitle you to a refund except as set out in Section 8.
Sections 9, 10, 14, 15, 16, 17, 20, and 21 survive termination of these Terms.
20 Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including internet or telecommunications outages, power failures, natural disasters, acts of government, labour disputes, or failures of third-party services (including WhatsApp, Google, or payment processors).
21 Governing Law & Dispute Resolution
These Terms, and any dispute or claim arising out of or in connection with them or the Service (including non-contractual disputes or claims), are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
If a dispute arises, you agree to first contact us via WhatsApp (Section 24) and attempt to resolve it informally and in good faith within thirty (30) days. If it is not resolved within that period, the dispute will be subject to the exclusive jurisdiction of the courts at Islamabad, Pakistan, and you consent to that jurisdiction and venue.
22 Changes to These Terms
We may update these Terms from time to time to reflect changes to the Service, legal or regulatory requirements, or our practices. The "Last updated" date at the top of this page will change accordingly. Material changes will be posted on this page; where reasonably practicable we will also notify active paying customers via WhatsApp. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to a change, you must stop using the Service.
23 General Provisions
23.1 Entire agreement
These Terms, together with the Claim & Provider Onboarding Terms (where applicable) and any order-specific terms confirmed in writing, constitute the entire agreement between you and DigiCard regarding the Service, superseding any prior agreements on the same subject.
23.2 Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
23.3 No waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
23.4 Assignment
We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of assets. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
23.5 Relationship of the parties
Nothing in these Terms creates a partnership, joint venture, agency, franchise, or employment relationship between you and DigiCard.
23.6 Language
These Terms are drafted in English. Where any Roman Urdu, Urdu, or other translated marketing copy on the Site conflicts with the English text of these Terms, the English version prevails.
23.7 Notices
We may give you notice via the contact number or channel you provided to us (including WhatsApp), or by posting on the Site. You may give us notice using the contact details in Section 24.
